Sampling Shop® Terms and Conditions

1.0           PRICES:
Prices may be given in British Pounds, US dollars or Euro. Prices exclude VAT which will be charged at the appropriate rate at the time of invoicing.
All prices are ex-works Coleshill , UK unless otherwise  stated. Packing, insurance and freight, will be charged at cost.  Custom Duties (where applicable) are to be paid by the Customer.

2.0           CONTINUOUS IMPROVEMENT & CHANGE CONTROL
We operate a policy of continuous improvement and as such we reserve the right to amend product specifications and prices without prior notice.
                Single Use, plastic SteriWare® products are covered by our Change Control policy. If you require notification of any major changes then contact Sampling Systems (change.control@sampling.com) with your email address.

3.0            DELIVERY DATES
Delivery dates are given in good faith and are an indication of the estimated delivery time. No responsibility is accepted by us for any loss resulting in or arising in connection with any delay.

4.0            PENALTY CLAUSES:
Sampling Systems do not accept Penalty Clauses unless expressly approved in writing by us.  We reserve the right to amend delivery and prices if Penalty Clauses are to form part of the Contract.

5.0            DOCUMENTATION:
Sampling Systems will provide free-of-charge a Certificate of Conformity for all products, the certificate will be in standard Sampling Systems format. If customer specific documentation is required then this may be liable to a documentation fee.

6.0            PAYMENT & TERMS:
For customers with a credit account invoices will be rendered for payment on despatch – payment in full is required within 30 days of invoice date.
All bank charges are payable by the customer and not Sampling Systems.
Payment is required by Bank Transfer on the date the invoice becomes due. Details of transfer accounts will be provided with our invoices.

7.0            EXCLUSIONS:
Prices are for the supply of equipment only. Our prices do not include: site attendance, installation, commissioning or training. 

8.0            TECHNICAL STANDARDS. 
Sampling Systems reserve the right to vary the specification of the equipment prior to the acceptance of any orders placed.  Thereafter, variations will be agreed with the Customer.    

9.0            CANCELLATIONS:
In  the event of order cancellation after order  placement,  Sampling Systems reserve the right to charge 25% of order value or for all work carried out if this is a greater amount, calculated on our standard hourly rates and usage of materials.

10.0         RETURNS POLICY:
                The customer must contact Sampling Systems to obtains a Returns Number, failure to do this may result in delays in sending out replacement goods or issuing a refund.
10.1 Custom made items can not be returned unless they are faulty.
10.2  Incorrectly Supplied or Faulty Goods:
If the incorrect or faulty goods are shipped they will be replaced by Sampling Systems at our cost.
10.3  Incorrectly Ordered Goods

• Stainless Steel Products - If the wrong stainless steel goods are ordered and the customer wishes to return them then a Restocking Fee will be charged at the rate of 20% of the value of the goods plus the shipping cost.
• Single Use Plastic Products – If single use plastic products are ordered incorrectly then these may not be returned

10.4 Returns Procedure
10.4.1       Contact Sampling Systems for a Returns Number. All goods must be clearly marked with the Returns Number
10.4.2       All carriage to be paid for by the customer (unless they are being returned due a fault or a packing error by Sampling Systems)
10.4.3       All customs duties to be paid for by the customer (unless they are being returned due a fault or a packing error by Sampling Systems)
10.4.4       If goods are returned in such a condition where rectification work is required then the cost of this work will be deducted from the refund. The customer is responsible for the goods until they are received back at Sampling Systems.

11.0         INSURANCE LIABILITY.
Sampling Systems insure the goods in carriage to the point of, but not including, unloading.
Goods should be examined on receipt and either signed for as accepted or the delivery note signed for "unexamined". If accepted "unexamined" then any damage must be notified within three days of receipt. No claims will be accepted after three days or if the goods have been accepted.
                Note: If a customer decides to use their own carrier then our insurance liability ceases the moment the goods leave our warehouse (or place where the customer collects the goods). Customers should provide their own shipping insurance.

12.0          FORCE MAJEURE
Sampling Systems shall not be liable in the event of non fulfilment of a contract owing to the act of God, war, disease, strike, lockouts, fire or any accident or incident of any nature whatever beyond the control of the Company.

13.0          DEMONSTRATIONS
If Sampling Systems are required to demonstrate the equipment – time for a skilled operator to set up and demonstrate will be charged at our standard rate

14.0          RESERVATION OF TITLE
All goods shall remain the property of Sampling Systems until goods have been paid for in full.

15.0         FIRST USE OF RE-USABLE GOODS
Re-usable stainless steel products are made in a metal working factory environment. This is a non-hygienic environment and consequently the products should be cleaned before first use. Customers should use the same processes and cleaning agents that are used for other small items of stainless steel processing equipment.

16.0         SINGLE USE DISPOSABLE PRODUCTS
Single-use disposable products should be examined to ensure that the bag is intact before the goods are used. If the bag is not intact the products should be rejected.
Single use disposable products are made from plastic. They are designed and constructed to be used once only. If they are used repeatedly then they will eventually fail.

17.0         WARRANTY OF RE-USABLE PRODUCTS
12 Months from despatch on the following basis:-
14.1         Free replacement parts and carriage to site only for standard propriety components such as electrical, pneumatic and hydraulic items (sensors, solenoid valves etc).  It does not cover the costs incurred by customer’s maintenance staff in diagnosing faults.
14.2         Parts and labour for failure of structural or design elements including components manufactured by Sampling Systems or it’s associates.
Note:        Most of the equipment supplied by Sampling Systems is of an inherently simple nature and fault diagnosis is relatively straightforward for a competent maintenance technician.  Sampling Systems will provide telephone assistance where required free of charge.

19.0         COPYRIGHT:
Specifications, drawings and other documentation supplied by Sampling Systems and the design concepts incorporated, are our copyright and may not be copied or reproduced in any other way, or used to obtain other offers, or used for any other purpose without our written approval. This condition applies until any order placed for the items offered is completed.

20.0         DATA PROTECTION
Personal data supplied by customers will be used by Sampling Systems in accordance with our Privacy Policy, which is available at www.sampling.com or on request from info@sampling.com .
